A Legal Disclaimer

Madu Enterprise V.B.A., doing business as Aruba Property Appraisals (‘the Company’), is the trade name under which the Company conducts its appraisal and valuation services. All references to ‘Madu Enterprise V.B.A.’ or ‘Aruba Property Appraisals’ in any documents, reports, or communications refer to the same legal entity.

By requesting or receiving appraisal services from Aruba Property Appraisals (“we,” “us,” or “our”), you (“Client”) agree to the following Terms and Conditions. These Terms supersede all previous versions. The most recent version shall always apply.

1. Service Description

Aruba Property Appraisals provides independent, data-informed real estate appraisal reports for informational purposes only. The service includes the analysis of market data, property inspection, and the delivery of a report estimating the current market value of the specified property.

2. Purpose and Use

The appraisal report is intended primarily for the Client’s informational and planning purposes. While it may be helpful for understanding current market conditions, it is not suitable for use in legal, financial, mortgage, or insurance matters.

3. Limitations of Liability

  • Aruba Property Appraisals shall not be held liable for any losses, claims, decisions, or damages—direct or indirect—arising from the use of the appraisal report.
     

  • The report reflects the estimated value based on available data and standard industry methodology at the time of analysis.
     

  • The Client acknowledges that the appraisal does not replace a structural inspection, title investigation, or legal due diligence.
     

  • Aruba Property Appraisals offers no warranties or assurances beyond the professional preparation of the report.

4. No Responsibility for Market Changes

Real estate values are influenced by external factors. Aruba Property Appraisals is not responsible for changes in market conditions, regulations, zoning, or external events that affect property value after the report is issued.

5. Client Responsibilities

  • The Client must provide accurate and truthful information.
     

  • Any omission or inaccuracy in property data may affect the reliability of the report.
     

  • The Client agrees not to alter, reproduce, or distribute the report to third parties without written approval.

6. Fees and Payment

  • All fees for services are due as agreed in writing or at the time of report delivery.
     

  • Fees are non-refundable once the report is delivered.

7. Confidentiality

Aruba Property Appraisals treats all appraisal data as confidential and will not share details with third parties, unless required by law or authorized in writing by the Client.

8. Intellectual Property

All appraisal reports and related materials remain the intellectual property of Aruba Property Appraisals. Reproduction or redistribution without permission is prohibited.

9. Applicable Law and Jurisdiction

These Terms are governed by the laws of Aruba. Any disputes shall be exclusively resolved by the competent courts of Aruba.

10. Updates to Terms

Aruba Property Appraisals reserves the right to update or modify these Terms at any time without prior notice. Continued use of the service constitutes acceptance of the latest version.
